March 24th, 2009Justice Douglas famously and prescientiy wrote in Packard Motor Car Co v. NLRB, “if [supervisors] are ‘employees’ within the meaning of the National Labor Relations Act so are vice-presidents, managers, assistant managers, superintendents, assistant superintendents-indeed,
all who are on the payroll of the company, including the president . . .but once [they] all are unionized, management and labor will become more of a solid phalanx than separate factions in warring camps.”1
